A jury should decide whether the Guess retail chain knocked off Gucci's signature "G" on products, a federal judge ruled on Feb. 14, 2012.
In 2009, Gucci filed a complaint stating, "In many instances, defendants have replicated entire Gucci product designs, to the point that there appears to be a concerted effort to 'Gucci-ize' defendants' product lines."
Guess denied all claims and filed a motion for summary judgment on June 6, 2011. Judge found that many of the issues in this case were inherently fact intensive and not amenable to summary judgment, and then denied the motion.
A jury will determine whether Guess tried to imitate Gucci's "Square G," "Script Gucci" and "GRG Stripe," U.S. District Judge Shira Scheindlin wrote.
Gucci wants about $26 million in damages.
A final pretrial conference is slated for March 13.
